Informed consent is recognized as a primary ethical requirement to conduct research involving humans. In the investigations with the use of human biological material, informed consent (IC) assumes a differentiated condition on account of the many future possibilities. This work presents suitable alternatives for IC regarding the storage and use of human biological material in research, according to new Brazilian regulations. Both norms – Resolution 441/11 of the National Health Council, approved on 12 May 2011, and Ordinance 2.201 (NATIONAL GUIDELINES (...) FOR BIOREPOSITORIES AND BIOBANKS OF HUMAN BIOLOGICAL MATERIAL FOR RESEARCH PURPOSE) of the Brazil Ministry of Health, approved on 14 September 2011 – state that the consent of subjects for the collection, storage and use of samples stored in Biobanks is necessarily established by means of a Free and Informed Consent Form (ICF). In order to obtain individual and formal statements, this form should contain the following two mutually exclusive options: an explanation about the use of the stored material in each research study, and the need for new consent or the waiver thereof when the material is used for a new study. On the other hand, ICF suitable for Biorepositories must be exclusive and related to specific research. Although Brazilian and international regulations identify the main aspects to be included in the IC, efforts are still necessary to improve the consent process, so that the document will become a bond of trust between subject and researcher. Em sua obra O segundo sexo “fatos e mitos”, Simone de Beauvoir se propõe uma genealogia do ser mulher considerando a questão do que fez da mulher o “outro”. Isto porque, em sua análise existencial, a filósofa percebe a situação da mulher como a do inessencial e inautêntico. A mulher estranha a si mesma pois se constitui como o outro do homem. E, por sua vez, vista pelo olhar masculino, a mulher é o misterioso de duas faces, é tudo aquilo (...) que o homem não é e não pode ser, o que faria da mulher o angustiante inexplicável da existência. Nesta alteridade negativa, é construída uma história da mulher no mundo e diversos mitos sobre o que é ser mulher, que resultam em uma situação. Evidentemente, uma situação opressiva, para a qual a autora considera ainda soluções, como a possibilidade de não se encerrar no destino materno e o ganho de poder aquisitivo — que livrariam as mulheres de sua sujeição social. Assim, expomos neste artigo como Simone de Beauvoir caracteriza a situação e os mitos da mulher, a fim de compreender porquê seria a mulher o segundo sexo. (shrink)

Neste artigo pretendemos mostrar as diferentes implicações epistemológicas e éticas da ideia de princípio fisiológico do conhecimento nas filosofias de Schopenhauer e Nietzsche. Pois, se para o primeiro isto será a garantia de afirmação de um conhecimento irracional, para o segundo é a confirmação da não possibilidade de conhecimento. Assim, veremos como, para Schopenhauer, o princípio fisiológico do conhecimento nos liga a essência do mundo e nos torna capazes de atingir em certas vias a própria coisa em si, a vontade. (...) Na filosofia de Nietzsche, tal princípio é a justa prova de que todo o conhecimento não se liga a nada mais do que a manutenção da vida, de forma que a linguagem e a “verdade” são apenas construtos para a sobrevivência humana. Observaremos também qual valoração de vida ambos filósofos imputam em suas considerações, já que, em Schopenhauer, vislumbrar a verdade é se dar conta do quão pouco valor a vida possui, enquanto em Nietzsche a tragédia da vida se mostra sempre afirmativa. The current research is based on Senninger’s Learning Zone Model applied to the tourists’ comfort zone. This model was created in 2000 and it proved to be useful in many applied areas: Psychology, Sociology, Marketing and Management. This modes is a behavioral one and shows how a person can justify his action based on previous tested experiences or dares to step beyond in fear, learn or growth zone. Our research is extending the existent area of expertise to tourism. We aimed (...) at exploring whether the tourists’ apprehension toward choosing their next destination from a comfort zone perspective or rather from the other zones’ perspectives such as fear, learning or growth. To meet this purpose we conducted a mixed method: firstly a qualitative one, an in-depth interview based on Delphi method with 10 tourism specialists and secondly an online survey on 208 Generation Z tourists. The interviews were meant to help developing a 20 items scale to measure from which of the 4 zones are the respondents making the choice of the future travel destination. Our conclusions show that Gen Z tourists display behaviors that can be associated with learning or growth zones rather than the comfort zone. This is relevant when choosing the next travel destination, because our findings could bring about a new approach to promoting tourist destinations as part of various products. As a result, a large range of managerial tools can better adapt the promotion messages to the target market from a new psychological perspective. (shrink)

Given that it seems uncontroversial that Socrates displays considerable contempt towards rhetoric in theGorgias,the title of this paper might strike one as an oxymoron. Indeed, a reading of the text has more than once encouraged scholars to posit an Opposition between the elenctic procedures championed by Socrates and the rhetorical procedures of his interlocutors. At least three features have been highlighted that seem to indicate this contrast:1.the Socratic interest in short questions and answers versus his interlocutors’ use of long speeches(makrologia);2.the (...) Socratic interest in truth regardless of the opinion of the many, the latter seeming an important concern of the rhetorician;3.the supposed Socratic appeal to the intellectual powers of the interlocutor, which is usually contrasted with the appeal to the emotions which is distinctive of rhetoric. We investigate the impact of informal arguments on judgments about thought experiment cases in light of Deutsch and Cappelen’s mischaracterization view, which claims that philosophers’ case judgments are primarily based on arguments and not intuitions. If arguments had no influence on case judgments, this would seriously challenge whether they are, or should be, based on arguments at all—and not on other cognitive sources instead, such as intuition. In Experiment 1, we replicated Wysocki’s (Rev Philos Psychol 8(2):477–499, 2017) pioneering study on (...) a Gettier-style case, and we confirmed that the informal arguments used by him had no significant effect. However, we also included an improved argument for ascribing knowledge, which did have a significant effect even in Wysocki’s original design. We therefore followed up with Experiment 2 on three Gettier-style cases, where we used a more natural dialogical format for presenting both case descriptions and informal arguments. Overall, we found a clear impact of prima facie good pro and con arguments on case judgments. The issue of argument impact is thus no obstacle to arguing about thought experiments. (shrink)

According to the ‘expertise defence’, experimental findings suggesting that intuitive judgments about hypothetical cases are influenced by philosophically irrelevant factors do not undermine their evidential use in (moral) philosophy. This defence assumes that philosophical experts are unlikely to be influenced by irrelevant factors. We discuss relevant findings from experimental metaphilosophy that largely tell against this assumption. To advance the debate, we present the most comprehensive experimental study of intuitive expertise in ethics to date, which tests five well- known biases of (...) judgment and decision-making among expert ethicists and laypeople. We found that even expert ethicists are affected by some of these biases, but also that they enjoy a slight advantage over laypeople in some cases. We discuss the implications of these results for the expertise defence, and conclude that they still do not support the defence as it is typically presented in (moral) philosophy. (shrink)

Family relations between Greek eponymous heroes almost certainly reflect political or commonly agreed ethnic relationships between the communities concerned. Pelops and his proverbially numerous descendants are investigated here from this perspective and it is argued that the creation of eponymous Pelopids was primarily due to political motivations. Pelops as one of the most remote ancestors of Sparta was used, already by the 5th century BC, to establish connections on a mythological level with those cities which became the allies of the (...) Lakedaimonians and are commonly known as the members of the Peloponnesian League. It is also suggested that after the battle of Plataea, these poleis erected a victory monument at Olympia on their own, which is commonly referred to as the “Achaean monument”. (shrink)

Experimental restrictionists have challenged philosophers’ reliance on intuitions about thought experiment cases based on experimental findings. According to the expertise defense, only the intuitions of philosophical experts count—yet the bulk of experimental philosophy consists in studies with lay people. In this paper, we argue that direct strategies for assessing the expertise defense are preferable to indirect strategies. A direct argument in support of the expertise defense would have to show: first, that there is a significant difference between expert and lay (...) intuitions; second, that expert intuitions are superior to lay intuitions; and third, that expert intuitions accord with the relevant philosophical consensus. At present, there is only little experimental evidence that bears on these issues. To advance the debate, we conducted two new experiments on intuitions about knowledge with experts and lay people. Our results suggest that the intuitions of epistemological experts are superior in some respects, but they also pose an unexpected challenge to the expertise defense. Most strikingly, we found that even epistemological experts tend to ascribe knowledge in fake-barn-style cases. This suggests that philosophy, as a discipline, might fail to adequately map the intuitions of its expert practitioners onto a disciplinary consensus. (shrink)

In this review, we present some ethical imperatives observed in this pandemic from a data ethics perspective. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. Empirical research in bioethics has developed rapidly over the past decade, but has largely eschewed the use of technology-driven methodologies. We propose “design bioethics” as an area of conjoined theoretical and methodological innovation in the field, working across bioethics, health sciences and human-centred technological design. We demonstrate the potential of digital tools, particularly purpose-built digital games, to align with theoretical frameworks in bioethics for empirical research, integrating context, narrative and embodiment in moral decision-making. Purpose-built digital tools can engender situated engagement (...) with bioethical questions; can achieve such engagement at scale; and can access groups traditionally under-represented in bioethics research and theory. If developed and used with appropriate rigor, tools motivated by “design bioethics” could offer unique insights into new and familiar normative and empirical issues in the field. (shrink)

Philosophical analysis was the central preoccupation of 20th-century analytic philosophy. In the contemporary methodological debate, however, it faces a number of pressing external and internal challenges. While external challenges, like those from experimental philosophy or semantic externalism, have been extensively discussed, internal challenges to philosophical analysis have received much less attention. One especially vexing internal challenge is that the success conditions of philosophical analysis are deeply unclear. According to the standard textbook view, a philosophical analysis aims at a strict biconditional (...) that captures the necessary and sufficient conditions for membership in the relevant category. The textbook view arguably identifies a necessary condition on successful philosophical analyses, but understood as a sufficient condition it is untenable, as I will argue in this paper. To this end, I first uncover eight conditions of adequacy on successful philosophical analyses, some of which have rarely been spelled out in detail. As we shall see, even sophisticated alternatives to the textbook view fail to accommodate some of these conditions. I then propose the concept grounding view as a more promising account of philosophical analysis. According to this view, successful philosophical analyses require necessary biconditionals that are constrained by grounding relations among the concepts involved. Apart from providing a satisfactory account of philosophical analysis in its own right, the concept grounding view is also able to meet the challenge that the success conditions of philosophical analysis are problematically unclear. In recent work, E. J. Lowe presents an essence-based account of our knowledge of metaphysical modality that he claims to be superior to its main competitors. I argue that knowledge of essences alone, without knowledge of a suitable bridge principle, is insufficient for knowing that something is metaphysically necessary or metaphysically possible. Yet given Lowe's other theoretical commitments, he cannot account for our knowledge of the needed bridge principle, and so his essence-based modal epistemology remains incomplete. In addition to that, (...) Lowe's account implies a psychologically unrealistic reconstruction of how we ordinarily acquire knowledge of metaphysical modalities. The discussion of Lowe's suggestive essence-based account is also intended as a case study that illustrates a more general problem in the epistemology of modality: the great difficulty of explaining our modal knowledge in terms of a single overtly nonmodal kind of knowledge. The failure of Lowe's account suggests that such a sweeping reductive explanation of our modal knowledge might simply not be available. This should be good news for those philosophers who champion less reductive or more pluralistic accounts of our modal knowledge. (shrink)

The impact of incidental emotions on decision making is well established. Incidental emotions can be differentiated on several appraisal dimensions, including certainty-uncertainty. The present research investigates the effect of certainty-uncertainty of incidental emotions on hedonic forecasting. The results of four experimental studies indicate that uncertainty associated incidental emotions, such as fear and hope, compared with certainty emotions, such as anger and happiness, amplify predicted utility. This amplification effect is confirmed for opposite utility types; uncertainty associated emotions, when compared with their (...) certainty counterparts, lead to an overprediction of positive utilities and to an underprediction of negative utilities. In line with the Appraisal-Tendency Framework (Lerner and Keltner, 2000; 2001), this effect is mediated by the prediction task uncertainty, providing evidence for a carryover process of the incidental emotion. The effect of task uncertainty on predicted utility is, in turn, partly mediated by attention to the task, suggesting that an affective adaptation process (AREA model; Wilson & Gilbert, 2008) lies behind the amplification of forecasts. Taken together, these findings extend the impact of certainty-uncertainty to the context of hedonic forecasting and further corroborate the impact of incidental emotions in judgement and decision making. Although a great deal has been written on Plato's ethics, his cosmology has not received so much attention in recent times and its importance for his ethical thought has remained underexplored. By offering accounts of Timaeus, Philebus, Politicus and Laws X, the book reveals a strongly symbiotic relation between the cosmic and human sphere. It is argued that in his late period Plato presents a picture of an organic universe, endowed with structure and intrinsic value, which both urges our respect (...) and calls for our responsible intervention. Humans are thus seen as citizens of a university that can provide a context for their flourishing even in the absence of good political institutions. The book sheds light on many intricate metaphysical issues in late Plato and brings out the close connections between his cosmology and the development of his ethics. (shrink)

In this paper, we report the results of three high-powered replication studies in experimental philosophy, which bear on an alleged instability of folk philosophical intuitions: the purported susceptibility of epistemic intuitions about the Truetemp case (Lehrer, Theory of knowledge. Westview Press, Boulder, 1990) to order effects. Evidence for this susceptibility was first reported by Swain et al. (Philos Phenomenol Res 76(1):138–155, 2008); further evidence was then found in two studies by Wright (Cognition 115(3):491–503, 2010) and Weinberg et al. (Monist 95(2):200–222, (...) 2012). These empirical results have been quite influential in the recent metaphilosophical debate about the method of cases. However, none of Swain et al.’s ( 2008 ) predictions concerning order effects with Truetemp cases could be consistently and robustly replicated in our three experiments, and it is thus at best unclear whether Truetemp intuitions are in fact unstable. So, if proponents of the negative program in experimental philosophy still want to use order effects to challenge the reliability of philosophical case judgments, they would be well advised to look elsewhere instead. In any case, given the more robust empirical evidence that we present in this paper, the metaphilosophical flurry created by Swain et al. ( 2008 ) and Wright’s ( 2010 ) influential studies looks like mere alarmism in hindsight. (shrink)

S’il n’y a pas de théorie du goût chez Rousseau, la question du goût traverse néanmoins toute son œuvre. Elle apparaît d’abord comme une critique adressée à la société mondaine, puis fait place, dans les écrits de la maturité, à une analyse des conditions sociales du bon goût général. En dépit de la terminologie classique de ses textes, ceux-ci développent en fait une conception sui generis du goût. Rousseau ne se réfère pas à un ordre de perfection pour expliquer et (...) fonder le bon goût. Le goût est selon lui un phénomène collectif qui manifeste l’état des affections sociales. Le goût tant social qu’individuel est dit « bon » lorsque le jugement sur ce qui plaît ou ce qui déplaît n’est pas soumis à l’opinion. L’autonomie du goût et le bon goût se confondent, la volupté et l’égalité relative en sont alors les conditions. (shrink)

En el siguiente artículo se analiza "Hopeful Monsters or, The Unfulfilled Figure in Hayden White´s Conceptual System", donde Kellner demuestra que la teoría de la figuralidad está latente desde el inicio de la teoría de Hayden White. Además, aplica el análisis figural a la propia obra de White afirmando que la teoría de los tropos será cumplimentada por el emplotment que, a su vez, será cumplimentado por el figuralismo. Luego se sigue el desarrollo de Kellner que muestra que en los (...) pasajes de White hay dos usos diferentes del concepto de unfulfillment: una noción de incumplimiento como figura que no llegó a su máxima potencia y una noción de incumplimiento como lo sublime indecible. Se examina específicamente la cuestión judía, asumiendo la misma como una figura incumplida y se rescatan las contribuciones del romanticismo y del iluminismo a su cumplimentación. Por último, se realizan algunas críticas a la insistencia de Kellner en el papel post teológico del figuralismo y al lugar del incumplimiento ligado a lo sublime como trascendiendo lo histórico. This work pretends to visualize the importance of the role that in the emergency, consolidation and expansion of the phenomenon of pathological view and over medication of the present childhood and adolescence seem to perform today certain types of criteria on which to base the undertaking of learning problems we are today faced with by children and teenagers in the classroom. To get this aim, we refer to re educated psycho educational practises, from which the cognitive-conductual views are questioned where (...) they supported on, and different interventionist typed are proposed from the clinical psycho pedagogical and psycho educational approach. With the aim of contribute to lectures from this area start to occupy a central place in the schedule developed on these subjects, considering that, frequently, they are postponed and relegated to the educational area, as if it had no connection with “the clinical” and the impact they have in the processes of establishing the subjectivity. Patentowanie ludzkich genów jest zjawiskiem, które w obecnych czasach nabrało intensywności i znaczenia. Jest jedną z kluczowych form zabezpieczania praw własności przemysłowej, zwłaszcza dla ośrodków badawczych i koncernów farmaceutycznych. Ze względu na naturę produktu podlegającego opatentowaniu, pomysł patentowania genów budzi wiele kontrowersji i rodzi spory na różnych płaszczyznach. Celem artykułu jest naszkicowanie ram prawnych dla tego zjawiska (m.in. porównanie regulacji europejskich i amerykańskich) oraz krytyczne omówienie argumentów przemawiających zarówno w obronie tej procedury, jak i przeciwko niej, wysuwane z różnych perspektyw: (...) prawnej (kwestia posiadania przez geny tzw. zdolności patentowej, kontrowersje związane z prawem własności do ludzkiego ciała), społeczno-ekonomicznej (wpływ zjawiska na rozwój badań naukowych oraz na ceny leków i dostępność różnych terapii) oraz etycznej (omówionej na podstawie wybranych kazusów). Artykuł zarysowuje również kilka propozycji rozwiązań praktycznych, które mają usuwać przynajmniej niektóre kontrowersje związane z patentowaniem genów. (shrink)

Worldwide interest in understanding art and creative practices as valid forms of knowledge production has led to the establishment of research-creation as an interdisciplinary academic field in the last twenty years in Canada as elsewhere. Its establishment relates to a growing interest in critical making and technological innovation and to the legacies of feminism(s) and its critique of the power dynamics of knowledge production within academia. This article outlines a series of interactive projects that bring visibility to Latin American women (...) in art, science and technology and speculates on the legacies of feminism(s) in the emergence of research-creation. The four projects discussed build on each other and explore re-mediation, re-activation and re-enactment as part of a collaborative feminist research-creation methodology. I theorize their potential to activate political memory by highlighting how these three approaches to creation share a preoccupation for revisiting the past through repetition, iteration and the facilitation of intergenerational encounters among humans, non-humans and across media and technologies. While discussing the feminist orientation of these approaches, I suggest a critique of dominant modes of knowledge production that have obscured the contributions of Latin American women and offer four research-creation interventions in the media arts archive. Scholarly debate over the transformative potential of neoliberal, market-based, food movement strategies historically contrasts those who value their potential to reform the food-system from the inside against those who argue that their use concedes the primacy of the market, creates citizen-consumers, and undermines overall movement goals. While narrow case studies have provided important amendments, the legacy of such strategies requires impacts to be evaluated both contextually and more broadly than the specific activism. This study thus conceptualizes the ‘case’ of U.S. (...) biotechnology market activism expansively, drawing on interviews with 25 activists from diverse organizations to investigate the legacy of two food-labeling movement strategies (one public and mandatory, one private and voluntary). The results support that the legacy of market strategies extends more broadly than the immediate initiative. They also confirm that the consequences of such neoliberalized strategies are most productively assessed contextually and applied, rather than categorically—as most clearly illustrated by the counterintuitive results of the failed mandatory labeling effort. Of the two market strategies, voluntary labeling demonstrated the most problematic relationship to broader movement goals of food system transformation, in part because of the greater potential for overlapping credence claims and in part due to the risks of niche market logic.
